Article 1: Purpose of the contract

The purpose of this contract is to sell tourist guidance services in Madagascar provided by the Provider. These services include guided tours, excursions and other services related to the tourist activity of the company Adventurers Madagascar Tours.

Article 2: Reservation procedure

Any reservation made by the Customer with the Provider is confirmed by the signing of this contract and payment of a deposit. The amount of the deposit and the total benefits to be provided will be detailed in the estimate and invoice.

The services included in the price are indicated in our estimate for a given number of participants. Any additional services requested by the traveller as well as any changes in the number of participants (additional registrations or cancellations) may change the total price of the trip and request a new estimate. Any service not mentioned is the responsibility of the client.

Price of the trip: The prices indicated in the programme are in [Euro/Dollars], VAT (including all taxes), and may be modified according to availability, exchange rate fluctuations or transportation and accommodation costs

Article 3: Description of services

The Provider undertakes to provide the following services to the Customer:

Details of the services will be specified in the estimate and accepted by the Customer.

Article 4: Conditions of payment

The Customer undertakes to pay the total amount of the services in the following manner:

Deposit of 30% of the total amount of benefits, payable upon signing the contract to confirm the reservation.
Balance of the total amount of benefits, payable prior to the provision of the services or as specified in the estimate.
Payment may be made by:

– Payment methods accepted: bank transfer, cash, online payment (western Unnion).

Article 5: Cancellation and repayment conditions

Cancellation by the Customer: In case of cancellation, whatever the reasons, the total amount of benefits remains due. No refunds, including the deposit paid, will be made.
Cancellation by the Provider: In case of cancellation by the Provider, another date may be offered to the Customer or a full refund will be made.

Article 6: Obligations of the Provider

The Provider undertakes to:

Provide services in accordance with the description provided in the estimate.
Carry out its activity in accordance with existing standards and necessary authorizations, in particular:

Article 7: Liability

The Provider may not be held responsible for external events affecting the performance, such as adverse weather conditions, strikes or other cases of force majeure. The Customer is responsible for his personal property during the performance.

Insurance: To cover your circuit, our land transport (4×4, minicar, bus......) are insured.

To participate in our trip, you are strongly advised to take out repatriation insurance and medical expenses abroad. You undertake to provide us with a copy of the contract specifying the names of the insured persons, the contract numbers, the details of the insurance company and the names of the persons to be contacted in case of emergency.

If you don't have repatriation insurance, we're not liable. Each customer is informed, taking into account the characteristics of Madagascar, that our travels may involve certain risks related, for example, to the remoteness of medical centres during the circuit/stay. Consequently, he must assume full responsibility for it and undertakes, together with his successor, not to hold us and the service providers responsible for any accidents that may occur during the journey. Furthermore, under no circumstances can we be held responsible for the physical insufficiency of a participant.

Article 8: Modification of benefits

Any changes to the services requested by the Customer must be validated by the Provider. Additional fees may apply depending on the change requested.

Article 9: Litigation and applicable law

In the event of a dispute, the Customer and the Provider shall endeavour to resolve the dispute amicably. In the absence of a friendly settlement, the dispute will be referred to the competent courts of Antananarivo, Madagascar, in accordance with the legislation in force.

Article 10: Acceptance of conditions

In signing this contract, the Customer confirms that he has read the terms and conditions of sale and accepts without reservation the terms of this contract.
